Agreement to these terms
These Terms & Conditions govern your use of Gibborim Foundry and the related services we provide (together, the “Services”). The Services are operated by Gibborim Games LLC, Franklin, Tennessee, United States.
By creating an account, starting a trial, purchasing a plan, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who may use the Services
You must be at least 18 years old to create an account or use the Services. You are responsible for the accuracy of the information you provide and for keeping your account credentials secure.
2. Your account
You are responsible for activity under your account. Do not share your password or use another person’s account without permission. Tell us promptly at hello@gibborimgames.com if you believe your account has been compromised.
3. Plans, payments, and cancellation
Paid plans, prices, and included features are shown in Foundry when you purchase. Payments are processed by Stripe. We do not receive or store your full card or bank details.
Subscription plans renew automatically until cancelled through the Stripe customer portal or by contacting us. You may cancel at any time; cancellation takes effect at the end of the current paid period unless Stripe or applicable law requires otherwise.
Because Foundry provides immediate access to digital services, payments are generally non-refundable except where required by law or where we decide a charge was made in error. Contact us at hello@gibborimgames.com if you need help with a charge.
4. Your content and forged work
“User Content” means the prompts, notes, campaign material, uploaded images, saved records, and other material you provide or store through Foundry. You keep ownership of your User Content.
You also keep ownership of the material forged for you through the Services, subject to any rights that may belong to other people or to the source material you supplied. We do not claim ownership of your campaigns, homebrew, saved records, or forged results.
You give us a limited permission to host, store, process, transmit, and display User Content only as needed to operate, secure, support, and improve the Services, comply with law, and enforce these Terms. This permission ends when your content is deleted from our active systems, subject to the retention limits described in our Privacy Policy.
If you send us direct feedback, ideas, or suggestions about Foundry, we may use that feedback without obligation or compensation. That permission does not give us ownership of your campaigns or other User Content.
5. How we use forged content
We do not sell your User Content. We do not use it to train artificial-intelligence models, and we do not authorize our commercial model provider to use it for training under our account.
Foundry is a creative tool. You are responsible for reviewing forged material before using it at your table, publishing it, or relying on it for any other purpose.
6. Player-share links
Some campaign features let you create a share link for a player. Anyone who has that link and its access token may be able to view or update the material you chose to share. Treat these links like private invitations and regenerate them if you believe they have been exposed.
7. Acceptable use
Do not use the Services to break the law; violate another person’s rights; interfere with security, rate limits, or access controls; scrape or reverse engineer the Services; send spam; introduce malicious code; or use the Services in a way that harms the platform or other people.
You must have the rights needed to provide your User Content. Do not submit material that infringes copyright, violates privacy or publicity rights, or is otherwise unlawful.
8. Our intellectual property
The Foundry software, visual identity, trademarks, site copy, and other material we provide, excluding your User Content and forged results, belong to Gibborim Games or its licensors. We grant you a limited, personal, non-transferable right to use the Services while you follow these Terms.
9. Third-party services
The Services rely on third parties for hosting, authentication, payments, email, analytics, rate limiting, and model processing. Their services are governed by their own terms and privacy practices. Our Privacy Policy explains the providers and the information involved.
10. Availability and changes
We work to keep Foundry available and reliable, but the Services are provided on an “as available” basis. We may change, suspend, or discontinue features when reasonably necessary for maintenance, security, legal compliance, or the continued operation of the Services.
11. Disclaimers and limits
To the fullest extent allowed by law, we provide the Services without warranties of any kind, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. We do not guarantee that forged material will be accurate, complete, original, or suitable for your particular game or use.
To the fullest extent allowed by law, Gibborim Games will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunity arising from use of the Services.
12. Suspension and termination
We may suspend or end access if you materially violate these Terms, create a security risk, or use the Services unlawfully. You may stop using the Services at any time and may delete your account through Account settings.
13. Governing law
These Terms are governed by the laws of Tennessee, United States, without regard to conflict-of-law rules, except where applicable law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. When we make a change, we will update the date at the top of this page. Continuing to use Foundry after an updated version takes effect means you accept the revised Terms.
